Under the Family Code, each parent has the right to see their child. This right is tempered by the best interest of the child. Eventually, the court in a custody proceeding decides what your rights are. The Court will decide, based on the evidence presented to it, which party shall be awarded custody and how much visitation will be given to the non-custodial party.
As a parent concerned about his/her children, it is important to present the best evidence on your behalf to the court. Often this can be in the form of declarations from people who know you well. Other times it is important to look into hiring an independent custody evaluator.
